These Terms of Service govern your access to and use of AiOOutreach (aiooutreach.com). By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

AiOOutreach is a cold email and outreach platform that runs campaigns through email accounts you connect yourself. You bring your own sending accounts (Mailjet, Mailgun, SendGrid, Brevo, Outlook, Gmail or a generic SMTP mailbox), import your leads, and AiOOutreach schedules and sends the campaigns you configure and syncs their delivery status.

AiOOutreach is the software layer. The actual email is sent and delivered by the providers you connect, and their terms apply to that mail.

The service is currently in beta and provided free of charge. Features may change, and the service is provided on an as-is and as-available basis without uptime or availability guarantees during beta.

We may introduce paid plans in the future. If we do, we will give you notice before any charges apply to your account.

You are solely responsible for how you use the service, for the content of your emails, and for the people you contact. In particular:

• You must have a lawful basis and the right to email the people on your lists.
• You must comply with all applicable laws, including anti-spam and privacy laws such as CAN-SPAM, GDPR, PECR and CASL.
• You must include accurate sender information and a working way to opt out, and you must honor unsubscribe requests promptly.
• You must comply with the terms and acceptable-use policies of every sending provider you connect. Some providers prohibit cold or unsolicited email; using them for that is a breach of their terms, and AiOOutreach cannot grant permission a provider does not.
• You are responsible for your own sender reputation and deliverability.
• You must not use purchased, rented or scraped lists where doing so is prohibited by law or by your provider.

You agree not to use AiOOutreach to:

• Send unsolicited bulk email in violation of law or provider terms.
• Distribute malware, phishing, scams, or deceptive, harassing, hateful or illegal content.
• Infringe the intellectual property or privacy rights of others.
• Attempt to gain unauthorized access to, disrupt, or overload the service or its infrastructure.
• Resell or provide the service to third parties without our written permission.

We may suspend or terminate accounts that violate these terms or that put the service, its providers, or other users at risk.

You are responsible for keeping your login and your connected sending-account credentials secure, and for all activity that happens under your account. Notify us promptly of any unauthorized use.

You retain ownership of the leads, templates and content you upload. You grant AiOOutreach the limited rights needed to store, process and transmit them solely to provide the service to you. Our handling of personal data is described in the Privacy Policy.

The AiOOutreach software, brand, and website are owned by AiOOutreach and its licensors. These terms do not grant you any rights in them other than the right to use the service as intended.

The service is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted or error-free, or that any email will reach the inbox.

Email deliverability depends on your connected providers, your own sender reputation, your list quality and your content, all of which are outside our control.

To the maximum extent permitted by law, AiOOutreach will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data, goodwill or reputation, arising out of or relating to your use of the service.

Because the service is provided free of charge during beta, our total liability to you for any claim is limited to the greatest extent permitted by applicable law.

You agree to indemnify and hold AiOOutreach harmless from any claims, damages, losses or costs arising from your use of the service, your email content, your contact lists, or your breach of these terms or of applicable law.

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these terms, or where necessary to protect the service, its providers or other users.

These terms are governed by the laws applicable where AiOOutreach operates, without regard to conflict-of-laws principles. Nothing in these terms limits any consumer-protection rights you may have that cannot be waived by agreement.

We may update these terms from time to time. Changes are effective when posted, and the Last updated date above will reflect the latest version. Your continued use of the service after changes take effect means you accept the updated terms.
